Terms of Service (TOS)

These Terms of Service (“Agreement”) are entered into by World Wideconsulting SL (“Company”) and the person or entity purchasing services (“Customer”). By using our hosting services, you agree to be bound by the following terms.

 

1. Services and Account Security

  • Provision of Services: We agree to provide the hosting and technical services selected by the Customer during the signup process.

  • Account Responsibility: You are responsible for all activity occurring under your account. You must maintain the confidentiality of your passwords and keep your contact information (especially your email address) up to date.

2. Fees and Payment

  • Billing Cycle: Services are billed on a [One Time/Monthly/Quarterly/Annual] basis. All fees are due at the start of the billing cycle.

  • Non-Payment: If payment is not received within [3/5] days of the due date, we reserve the right to suspend your services. If payment remains outstanding for [14] days, your account and all associated data may be permanently deleted.

3. Service Level Agreement (SLA) & Uptime

  • Uptime Goal: We strive to maintain a [99.9%] network uptime.

  • Maintenance: We may occasionally perform scheduled maintenance. We will provide at least 24 hours' notice for any planned downtime.

  • Limitations: Uptime guarantees do not apply to downtime caused by Customer-side scripts, third-party software, or external network issues beyond our control.

4. Backups and Data Loss

  • Customer Responsibility: While we may perform routine backups for our own disaster recovery, the Customer is responsible for maintaining their own off-site backups.

  • Liability: To the maximum extent permitted by law, World Wideconsulting SL shall not be held liable for any data loss, regardless of the cause.

5. Prohibited Conduct (AUP)

  • Use of our services is strictly subject to our Acceptable Use Policy (AUP). Any violation of the AUP is considered a material breach of this Agreement and may result in immediate termination without refund.

6. Limitation of Liability

  • "As Is" Basis: Services are provided on an "as is" and "as available" basis.

  • Damages Cap: In no event shall World Wideconsulting SL be liable for any indirect, incidental, or consequential damages (including loss of profits). Our total liability to you for any claim shall not exceed the amount paid by you for the services during the [3] months prior to the claim.

7. Term and Termination

  • Termination by Customer: You may cancel your service at any time via your client dashboard.

  • Termination by Company: We reserve the right to terminate this Agreement at any time if you violate these terms, fail to pay, or if your use of the services poses a security risk to our network.

8. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the EU, without regard to its conflict of law principles.
